A jury of eight is expected to be seated Tuesday in Taylor Swift's civil trial involving a groping allegation against a former Denver DJ.

Attorneys for Swift, one of the most powerful celebrities in the world, argued in opening statements that Mueller was using her notoriety and fame for his own gain.

Swift and Mueller are not required to be in court for jury selection, which will take two days, but must be present for the rest of the trial.

Jurors will try to decide whether a radio host groped the pop superstar during a photo op before a concert in Denver in 2013 - and whether she and her team got him fired.

According to the litigation filed against the DJ it has been reported that Mueller slipped his hand under Swift's dress and grabbed her backside as they posed for a photo-shoot before the concert.

In 2015 Mueller sued Swift, her mother Andrea Swift and her radio promotions director Frank Bell, claiming that the touching allegations are false.

Swift then countersued for assault and battery, and that became part of the same trial.

Mueller says the photo only shows him trying to jump into the frame.

Martinez will allow Bayard de Volo to testify why Swift might have waited to report Mueller's alleged assault, but she will not be allowed to talk about why she believed Mueller might be prone to commit an assault because his masculinity had been threatened due to anxiety with his job.

Opening statements are expected on Tuesday afternoon in a case that could last two weeks.

McFarland also suggested that Mueller may have been a victim of mistaken identity and that Swift might be confusing him with another man who was there.

Mueller was the first witness called to the stand - where he said once again under oath that he did not grope the celeb when he hopped into the controversial photo.

"The contention that Mr Mueller lifted up Ms Swift's skirt and grabbed her bottom, while standing with his girlfriend, in front of Ms Swift's photographer and Ms Swift's highly trained security personnel, during a company-sponsored, VIP, backstage meet-and-greet, is nonsense", wrote his lawyer in court documents.

The singer also attended jury selection on Monday. One said on her questionnaire that she found Ms Swift "petty and dishonest".

In addition to Swift, Mueller named her mother and a member of her team as defendants in the lawsuit.
