Alex Wubbels was rushed by an officer, handcuffed and taken into custody at University of Utah hospital in late July after following a hospital policy that police wanted to violate.

Ms Wubbels told Mr Payne that a patient needed to grant permission for blood to be taken in order to determine intoxication or be under arrest, otherwise police require a warrant.

The policy states that blood can not be taken from a patient believed to be "under the influence" for police purposes, unless they have been arrested, a warrant for the procedure has been obtained or the patient has consented.

"Please sir, you're hurting me", Wubbels said.
