"As evident from the constitutional guarantee flowing from Article 19 of the Constitution, the right to reside and settle in any part of the territory of India as well as right to move freely throughout the territory of India is available only to the citizens of India".

The Centre has told the Supreme Court that many Rohingyas have acquired documents meant for Indian citizens only like Aadhaar, PAN and Voter-ID.

Pointing that the influx of Rohingya refugees from Myanmar started in 2012-13, the Centre said there was an organised "influx of illegal immigrants from Myanmar through agents and touts" facilitating their entry into India through West Bengal, Tripura and Assam.

Though India has the biggest number of refugees in the country in the entire South Asia and dealt with one of the biggest refugee crises in the world during partition of the country seven decades back, New Delhi does not have a refugee specific law.

Senior home ministry official Mukesh Mittal said the Indian government would privately show the court material gathered from "sensitive investigations" to substantiate its claims. Accusing New Delhi of looking at the issue from a religious angle, he said while amending the Foreigners Act in 2015, it gave certain exemptions to Hindus, Sikhs, Parsis, Christians and Jains arriving from Pakistan and Bangladesh, but the word Muslim was not included.
