  • 'Judge Loya's death was natural': SC dismisses pleas seeking inquiry into the case

Congress said on Thursday that the Supreme Court's dismissal of petitions seeking Special Investigation Team (SIT) probe into Justice Loya's death case marks a sad day in India's history. While the BJP and the Congress were locked in a high-decibel back-and-forth over the Supreme Court's ruling, Rahul Gandhi took to Twitter to say: "Indians are deeply intelligent".

"The people who have been politicising the judiciary for their own motives, now stand exposed", he said at a press conference.

Mr Surjewala also stressed that the Congress was not among the petitioners seeking a probe into the judge's death and recalled that the party had instead approached the people's court and approached President Ram Nath Kovind along with 14 other opposition parties.

Three of the judicial officers, the court said, had travelled with Judge Loya by train from Mumbai to Nagpur to attend a wedding reception. The statements contain matters of detail, which would be known to those who were present with judge Loya.

The BJP's attempt to misinterpret the Supreme Court judgement reflects their jitteriness and frustration.

The BJP, earlier in the day, said that Congress President Rahul Gandhi is behind all the petitions filed in the Supreme Court regarding this issue.

She will "forever remembered by those who knew her, loved her and were impacted by her dedication to public service", he said . Former Vice President Dick Cheney and his wife, Lynne Cheney, will attend as well, according to a source close to the family.

Holding that there was absolutely no merit in the petition, a bench of Chief Justice Dipak Misra, Justice A.M. Khanwilkar and Justice D.Y. Chandrachud said Judge Loya had met a natural death. After Loya's death, Shah was discharged and the CBI refused to file an appeal against the verdict. "This would be in the larger public interest, to uphold the independence and integrity of the institution", the court said.

Demanding an apology from Gandhi and Congress for trying to "frame" Shah and BJP, Javadekar said Congress was resorting to "dirty politics" in desperation as it was losing elections in every state.

Senior lawyer Prashant Bhushan, one of the petitioners in the case, said the court rejected all the petitions despite the evidence presented in court. "Courts are not the place to settle business or political rivalry which has to be fought in markets or elections", the bench observed. "The attempt of the petitioners was to malign the judiciary", the bench hearing the petitions said.

In November past year, Caravan magazine published a report in which Loya's relatives were quoted as alleging that Loya was under "immense pressure to give a favourable verdict in the case", raising questions about the circumstances of his death.
